The immigration and refugee board of Canada(IRB)

The IRB was established in 1989. It was established by an Act of Parliament. It is an independent administrative tribunal responsible for making immigration and refugee matters decisions.  Made by individuals, the Immigration and Refugee Board of Canada(IRB) decides on applications for refugee protection.

It is Canada's largest independent administrative tribunal. The immigration and refugee board of Canada makes decisions on all kinds of immigration and refugee matters that take place in Canada. The IRB decides who needs refugee protection.

It hears appeals on certain immigration matters. It conducts admissibility hearings and detention reviews as compared to the justice provided by the court, the IRB generally strives to deliver a more straightforward and faster form of justice. The  IRB is a human rights tribunal. The women and men who work at the IRB respect the human dignity of everyone who comes and tells their problems related to various immigration matters.

It is Canada's largest independent administrative tribunal. It operates at arm’s length from the gov. IRB is responsible for resolving immigration and refugee cases efficiently, fairly and honestly without any partiality. They contribute to the security of Canadians. They also contribute to the integrity of Canada's immigration.  In Canadian history, refugees and immigrants have always been their part. 

Services and information:

  • Making a claim: It involves making a claim. Focuses on submitting all the necessary documents. It also includes attending the hearing. Then waiting for the decision.
  • Attending your hearing: In the hearing part, the RPD will send you a mail. In the mail, there will be a notice to appear. So there will be two dates. The first date is the date of your hearing in which you are supposed to come and complete the hearing by giving the answers to all the questions. If we talk about the second date, it includes a notice to appear for a special hearing.

So, hearings usually take half a day and take place in private. If you have any concerns or questions about your child participating in the hearing, contact the RPD. If you do not attend your hearing, you must appear at your special hearing to explain why you could not attend. 

Providing the basis for your claim:

You have to fill out the BOC form. In this, you have to present your claim by providing details about who you are and why you seek protection in Canada. The member may ask you questions about anything. He or she will ask you the questions you have included in your BOC Form. To support your claim, you should also submit other documents, which include identity documents and evidence of human rights etc. 

Receiving your decision: You will get protected person status if the claim is accepted. And If the claim is rejected, you may choose to leave Canada voluntarily. If you are eligible, you can appeal to the RAD. You must file your appeal within 15 days of receiving your decision notice. You can apply to the federal court if you are not eligible to appeal to the RAD​.

Filing a refugee appeal: You can appeal to the RAD under specific conditions if you want to appeal. You have the right to respond to the appeal if you were granted refugee protection by the RPD and the minister is appealing that decision.

To Make a complaint to the Immigration and Refugee Board of Canada: Anyone can make a complaint to the IRB. You can complain about an IRB member's conduct or anyone. Complaint about a person representing a client at the IRB for a fee but not authorized by a law society. The conduct and services of an Interpreter. 

  • Preparing for detention reviews and admissibility hearings.
  • Filing a refugee appeal 
  • Members conduct issues.

The four tribunals of the immigration and refugee board of Canada(IRB) are:

  • Refugee Protection Division: The RPD decides claims for refugee protection.
  • Refugee Appeal Division: The RAD considers appeals against certain decisions of the refugee protection division.
  • Immigration Division: Conducts immigration admissibility hearings for certain categories. It is for those detained by the Canada border services agency.
  • Immigration Appeal Division: It hears appeals of sponsorship applications refused by citizenship and immigration Canada officials. It also includes the holders of permanent resident visas. Appeals by permanent residents who have been found outside of Canada not to have fulfilled their residency obligation and the appeals by the Canada border services agency.

The primary role of the IRB Canada: It is responsible for making well-reasoned decisions on immigration and refugee matters, fairly and honestly. They should make the decision following the law.

Why IRB is necessary: To determine if the research project follows ethical principles, the immigration and refugee board of Canada(IRB) reviews the proposals before a project is submitted to a funding agency. It should also follow federal regulations. IRB has the authority to approve or disapprove of these projects.

Does IRB protects human subjects: The primary purpose of the institutional review board for protecting human subjects in research is to protect the rights and welfare of human research subjects by ensuring that physical, psychological, and legal risks to subjects are minimized.

Three types of IRB reviews: The three types of reviews are Exempt, Expedited, and Full.  For all projects that meet the definition of research, IRB must review them. To involve human participants before any data collection to determine the appropriate level of review.

What the immigration and refugee board of Canada(IRB) protects: IRB is an administrative body established to protect human research subjects' rights and welfare.

Next, after IRB approval: After the approval, any subsequent changes to the study must be reviewed and approved by the IRB before implementation. This includes changes to the research team, recruitment process or material, consent procedures or materials, participant payment etc. and many more.

Limited IRB review: It is a process that is required only for certain exemptions and does not require an IRB to consider all of the IRB approval criteria in §46.111. In limited IRB review, the IRB must determine certain conditions.
