Detailed Information about Work Permit Application Canada

Work Permit: Canada is ranked high in the global living index. It’s the first choice of many to live in Canada on a permanent basis. First step towards this process is: Work permit application Canada.

 

A work permit allows nationals of other countries to work in Canada on a ‘Canada work Visa’. Every year thousands of foreign nationals apply for a Canada work permit Visa. There are 2 types of Canada work permits under which candidates can apply.

 

1. Employer work visa: In employer work permit, you can apply for a work visa Canada under a specific employer with the details of your employment time and place. Your employer will provide you with the details of your employment contract and a copy of your LMIA.

 

2. Open work visa: As the name suggests, it doesn’t need a specific employer. You can work under any employer as long as they are permitted. There are several categories under which you can have an open work permit:

d. Open work permit for refugees.

To apply for a work permit Canada, candidates must apply to Immigration, Refugees and Citizenship Canada IRCC.  There are two programs under you can apply:

 

Temporary Foreign Worker Program: In TFWP, A Labour Market Impact Assessment (LMIA) is required for applicants for a Canada work permit visa. They have a temporary work permit application in Canada.

 

The programs that require LMIA are mainly:

 

1. Temporary Foreign worker Program (TFWP)

2. Facilitated LMIA (Quebec)

3. Global Talent Stream

 

International Mobility Program: In IMP, An LMIA is not required by the applicants for Canada work permit Visa. The programs that don’t require a LMIA but still need a job offer from the Employer. These are:

 

1. International Mobility Program (IMP)

2. Canada-United States-Mexico Agreement, or CUSMA. 

3. Intra Company Transfers.

4. Comprehensive Economic and Trade Agreement (CETA)

 

Eligibility for Canada Work permit Visa: Candidates who want to work in Canada, should apply for a Job Visa for Canada. When apply for work permit Canada, one must fulfill certain eligibility criteria:

 

1.  Must have a Job offer from an eligible employer.

2. Must have a Labor Market Impact Assessment (LIMA).

3  Must not have any criminal record.

4. Must provide the proof of adequate funds.

5. Must provide a medical certificate.

 

Out of many available options for Work Permit Application Canada, each has different requirements. Some work permits require a job offer from a Canadian employer, some require that the employer provide a (LMIA), while others require that if a person has Canadian education. 

 

Labour Market Impact Assessment (LMIA) : An LMIA is an assessment document from Employment and Social Development Canada (ESDC) for employers to hire temporary workers from other nations.

 

LMIA helps ESDC to calculate the effect of hiring workers of other nations on Canada’s economy. A positive or Negative LMIA is issued to the employer by ESDC. This copy is provided to the applicants by the employers to add in their visa application.

 

Facilitated LMIA: LMIA is used for all the provinces of Canada except Quebec. Quebec has its own facilitated LMIA. Generally in LMIA, the employer has to provide proof that they were unable to find a Canadian citizen or PR for the job. 

 

But this is not the case with Quebec. They can hire a foreign national without advertising for the job for citizens and PR holders. The employers can only hire workers for high demand professions and also in case of labor shortage. The main requirement for Facilitated LMIA is that the application should be in french.  

 

Global talent Stream: in this stream highly talented foreign works are hired who will help Canada on an international level. In this, many employers make a partner with GTS to hire highly efficient workers under category A & B. Both categories have some different requirements for workers.

 

Work Permit Application Canada:

 

There are many ways to obtain a work visa in Canada depending upon which category you are applying for. For example, if you are a spouse or common law partner of the Visa applicant, then you will get an Open work permit. If you are a student, then you are automatically eligible for a part time work visa.

 

When applying for a work visa Canada, most candidates require a job offer with a  LMIA. There are also some employers who are LMIA exempt but they still need to provide a valid job offer.

 

This is also called a closed work permit as you have to work for the specific employer whereas in an open work permit you can choose the employer of your own. With a Canadian job offer, it's not certain that you will get a work visa. There are many other requirements that you should meet.

 

Once you fulfill all the requirements for a work Visa, you can apply for one. It typically takes a maximum of 6 to 9 months to get a work visa. You have to follow the certain restrictions that come with your work visa. This depends on the type of work permit you have. These apply on both closed and open permits.

 

With An open work permit you can work for any employer but there are still some jobs which you can not do. For example, a job where national issues are concerned or a job where there are chances of sexual exploitations.

 

But having a work permit doesn’t mean you can permanently live in Canada. If you want to live permanently in Canada, then you should apply for the permanent residency by fulfilling the eligibility criteria for the same.

 

The good thing about a Canadian Work permit is that you can also bring your children and spouse under the age of 18 with you. They can attend the school without applying for a study visa. And your spouse is also eligible for an open work permit.

 

After you apply for the work permit, a complete check of documents is done along with your biometrics. Also if necessary, an interview will be conducted by the officials. Additional documents if required shall also be provided. 

 

When you arrive in Canada after your visa is granted, you will need to get your social insurance number SIN to work in Canada.
